GravesDiary End User Licence Agreement
Please read this agreement before using GravesDiary. By installing or using the software you accept these terms. If you do not accept them, do not use the software.
1. Licence granted
GravesWare, LLC (“GravesWare”) grants you a non-exclusive, non-transferable licence to install and use GravesDiary (“the Software”) on computers you own or control, for your own purposes.
This is a licence to use the Software. The Software is not sold to you.
2. What you may not do
You may not:
- reverse engineer, decompile or disassemble the Software, except to the extent that applicable law expressly permits it despite this term;
- rent, lease, lend, sell or sublicense the Software;
- remove or alter any copyright, trademark or other proprietary notice;
- use the Software to infringe the rights of others, or in breach of any applicable law.
3. Ownership
The Software is the property of GravesWare and is protected by copyright and other intellectual property laws. GravesWare reserves all rights not expressly granted to you.
What you write in the Software, and the photos and files you attach to it, remain entirely yours. GravesWare claims no rights in them and never receives them.
4. Third-party components
The Software includes third-party components licensed separately by their owners. Those components are listed in the Third-Party Notices accompanying the Software, and their licences govern their use. Nothing in this agreement limits any right you have under those licences.
Every such component is under a permissive licence — MIT, Apache 2.0, BSD 3-Clause, the SIL Open Font License, or dedicated to the public domain. None imposes a copyleft obligation on the Software or on you.
5. Encryption, passwords and passphrases
The Software keeps your diary encrypted with AES-256 (SQLCipher), and can encrypt what it writes to a sync folder with AES-256-GCM.
YOUR DIARY PASSWORD AND YOUR SYNC PASSPHRASE CANNOT BE RECOVERED. GravesWare cannot recover them, cannot reset them, and cannot decrypt your diary or your sync folder without them. There is no backdoor, no recovery key and no master password. If you lose the password, the diary on that computer is permanently unreadable; if you lose the sync passphrase, so is the sync folder. This is how the encryption is intended to work.
If you choose to use the Software without a password, the diary is encrypted with a key stored on your computer, readable by your user account. Anyone who can use that account can read the diary. The Software tells you this when you choose.
You are responsible for choosing passwords and passphrases of sufficient strength, for storing them safely, and for keeping backups of anything that matters to you in a form you can still read.
GravesWare makes no representation that encryption applied by the Software satisfies any particular legal, regulatory, contractual or evidentiary standard in any jurisdiction, or that it is suitable for protecting any particular category of regulated data. Whether a given method is adequate depends on the circumstances and the law that applies to you.
Encryption protects the contents of your diary and of the sync folder. It does not conceal that the files exist, or their sizes and modification times. The Privacy Statement accompanying the Software explains what each file reveals.
6. Sync folders and other services
The Software can keep several computers in step through a folder you choose, such as one kept by OneDrive, Dropbox, Google Drive or Syncthing, or a network share. The Software writes to that folder and reads from it. It does not operate, control or connect to the service that copies the folder between your computers, and your use of that service is between you and its provider, under its terms.
GravesWare does not warrant that any such service will copy the folder completely, promptly or at all.
7. No warranty
THE SOFTWARE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.
GRAVESWARE DOES NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT IT WILL SYNCHRONISE EVERY CHANGE BETWEEN YOUR COMPUTERS, OR THAT A DIARY WRITTEN BY IT WILL BE READABLE BY A LATER VERSION OF THE SOFTWARE.
GRAVESWARE DOES NOT WARRANT THAT ENCRYPTION APPLIED BY THE SOFTWARE WILL RESIST ANY PARTICULAR ATTACK, OR THAT IT WILL REMAIN SECURE AGAINST FUTURE ADVANCES IN CRYPTANALYSIS OR COMPUTING CAPABILITY.
YOU ARE RESPONSIBLE FOR MAINTAINING BACKUPS OF YOUR DIARY. A SYNC FOLDER IS NOT A BACKUP: A DELETION MADE ON ONE COMPUTER IS SYNCHRONISED TO THE OTHERS.
Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GRAVESWARE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA OR FILES, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THIS INCLUDES LOSS ARISING FROM A FORGOTTEN PASSWORD OR PASSPHRASE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GRAVESWARE’S TOTAL LIABILITY UNDER THIS AGREEMENT SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE, OR TWENTY-FIVE UNITED STATES DOLLARS (US$25), WHICHEVER IS GREATER.
Some jurisdictions do not allow these limitations, so parts of this section may not apply to you.
9. Privacy
The Software sends nothing to GravesWare and collects nothing about you. It writes your diary to your computer and, if you choose, to a sync folder you choose. See the Privacy Statement accompanying the Software.
10. Term and termination
This agreement applies until terminated. It terminates automatically if you breach it. On termination you must stop using the Software and remove all copies. Sections 3, 5, 7, 8 and 12 survive termination.
11. Export and sanctions
The Software contains and performs cryptographic functions. Laws in some countries restrict the import, use, distribution or re-export of cryptographic software, and those restrictions apply to you regardless of anything in this agreement.
You may not use, export or re-export the Software in violation of any applicable export control, sanctions or trade law, including to any embargoed destination or any person or entity subject to applicable sanctions. You are responsible for determining what applies to you in your jurisdiction.
12. Governing law
This Agreement is governed by the laws of the Commonwealth of Virginia, United States, without regard to its conflict-of-laws rules. The exclusive venue for any dispute is the state courts located in Montgomery County, Virginia, or the federal courts serving that county, and you consent to their jurisdiction.
13. Entire agreement
This agreement is the entire agreement between you and GravesWare regarding the Software, and supersedes any prior understanding. If any provision is held unenforceable, the rest remains in effect.
