Please read this agreement before using GravesPDF. By installing or using the software you accept these terms. If you do not accept them, do not use the software.

1. Licence granted

GravesWare, LLC (“GravesWare”) grants you a non-exclusive, non-transferable licence to install and use GravesPDF (“the Software”) on computers you own or control, for your own purposes.

This is a licence to use the Software. The Software is not sold to you.

2. What you may not do

You may not:

1. reverse engineer, decompile or disassemble the Software, except to the extent that applicable law expressly permits it despite this term;
2. rent, lease, lend, sell or sublicense the Software;
3. remove or alter any copyright, trademark or other proprietary notice;
4. use the Software to infringe the rights of others, or in breach of any applicable law.

3. Ownership

The Software is the property of GravesWare and is protected by copyright and other intellectual property laws. GravesWare reserves all rights not expressly granted to you.

Documents you create, open or edit with the Software remain entirely yours. GravesWare claims no rights in them.

4. Third-party components

The Software includes third-party components licensed separately by their owners. Those components are listed in the Third-Party Notices accompanying the Software, and their licences govern their use. Nothing in this agreement limits any right you have under those licences. The notices are published on the About page of this site.

5. Digital signatures

The Software can apply and check cryptographic signatures on PDF documents.

GravesWare makes no representation that a signature created or verified by the Software satisfies any particular legal, regulatory or evidentiary standard in any jurisdiction. Whether a given signature is legally effective depends on the certificate used, the circumstances of signing, and the law that applies to you.

Signature verification in the Software reports whether a document has been altered since signing and whether the signature covers the whole file. It does not establish the identity of the signer, and does not check whether a signing certificate is trusted, valid or revoked. Do not rely on it as proof of identity.

You are responsible for the security of your signing certificates and their passwords.

6. No warranty

THE SOFTWARE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.

GRAVESWARE DOES NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT IT WILL PRESERVE, CORRECTLY RENDER OR CORRECTLY MODIFY ANY PARTICULAR DOCUMENT. PDF IS A COMPLEX FORMAT AND DOCUMENTS VARY WIDELY.

YOU ARE RESPONSIBLE FOR MAINTAINING BACKUPS OF ANY DOCUMENT THAT MATTERS TO YOU.

Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.

7. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GRAVESWARE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA OR DOCUMENTS, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GRAVESWARE’S TOTAL LIABILITY UNDER THIS AGREEMENT SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE, OR TWENTY-FIVE UNITED STATES DOLLARS (US$25), WHICHEVER IS GREATER.

Some jurisdictions do not allow these limitations, so parts of this section may not apply to you.

8. Privacy

The Software collects nothing and transmits nothing. See the Privacy Statement accompanying the Software.

9. Term and termination

This agreement applies until terminated. It terminates automatically if you breach it. On termination you must stop using the Software and remove all copies. Sections 3, 6, 7 and 11 survive termination.

10. Export

You may not use or export the Software in violation of any applicable export control law.

11. Governing law

This agreement is governed by the laws of the Commonwealth of Virginia, United States of America, without regard to its conflict of laws rules. The courts located in Montgomery County, Virginia shall have exclusive jurisdiction over any dispute arising from it.

12. Entire agreement

This agreement is the entire agreement between you and GravesWare regarding the Software, and supersedes any prior understanding. If any provision is held unenforceable, the rest remains in effect.
