GravesZIP End User Licence Agreement

GravesWare, LLC — version 1.0.0

Please read this agreement before using GravesZIP. By installing or using the software you accept these terms. If you do not accept them, do not use the software.

1. Licence granted

GravesWare, LLC (“GravesWare”) grants you a non-exclusive, non-transferable licence to install and use GravesZIP (“the Software”) on computers you own or control, for your own purposes.

This is a licence to use the Software. The Software is not sold to you.

2. What you may not do

You may not:

  1. reverse engineer, decompile or disassemble the Software, except to the extent that applicable law expressly permits it despite this term;
  2. rent, lease, lend, sell or sublicense the Software;
  3. remove or alter any copyright, trademark or other proprietary notice;
  4. use the Software to infringe the rights of others, or in breach of any applicable law.

3. Ownership

The Software is the property of GravesWare and is protected by copyright and other intellectual property laws. GravesWare reserves all rights not expressly granted to you.

Files you compress, encrypt, open or extract with the Software remain entirely yours. GravesWare claims no rights in them.

4. Third-party components

The Software includes third-party components licensed separately by their owners. Those components are listed in the Third-Party Notices accompanying the Software, and their licences govern their use. Nothing in this agreement limits any right you have under those licences. The notices are published on the About page of this site.

Every such component is under a permissive licence — MIT, BSD 3-Clause, or the SIL Open Font License. None imposes a copyleft obligation on the Software or on you.

The Software does not include or require 7-Zip.

5. Encryption and passphrases

The Software can encrypt archives using AES-256, in the WinZip AES format that ordinary archiving tools read.

YOUR PASSPHRASE CANNOT BE RECOVERED. GravesWare cannot recover it, cannot reset it, and cannot decrypt an archive without it. There is no backdoor, no recovery key and no master password. If you lose the passphrase, the contents of the archive are permanently unreadable. This is how the encryption is intended to work.

You are responsible for choosing passphrases of sufficient strength, for storing them safely, and for keeping backups of anything that matters to you in a form you can still read.

GravesWare makes no representation that an archive encrypted by the Software satisfies any particular legal, regulatory, contractual or evidentiary standard in any jurisdiction, or that it is suitable for protecting any particular category of regulated data. Whether a given method is adequate depends on the circumstances and the law that applies to you.

Encryption protects the contents of an archive. It does not conceal the existence, name, size or modification time of the archive file itself, and for some formats it does not conceal the names of the files within. The Privacy Statement accompanying the Software explains what each format does and does not protect.

6. No warranty

THE SOFTWARE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.

GRAVESWARE DOES NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT ANY ARCHIVE IT CREATES WILL BE READABLE BY OTHER SOFTWARE OR BY A LATER VERSION OF THE SOFTWARE, OR THAT IT WILL CORRECTLY READ ANY PARTICULAR ARCHIVE. ARCHIVE FORMATS VARY WIDELY AND ARCHIVES ENCOUNTERED IN PRACTICE ARE OFTEN MALFORMED.

GRAVESWARE DOES NOT WARRANT THAT ENCRYPTION APPLIED BY THE SOFTWARE WILL RESIST ANY PARTICULAR ATTACK, OR THAT IT WILL REMAIN SECURE AGAINST FUTURE ADVANCES IN CRYPTANALYSIS OR COMPUTING CAPABILITY.

YOU ARE RESPONSIBLE FOR MAINTAINING BACKUPS OF ANY FILE THAT MATTERS TO YOU. DO NOT DELETE YOUR ONLY COPY OF SOMETHING BECAUSE IT IS NOW IN AN ARCHIVE.

Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.

7. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GRAVESWARE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA OR FILES, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THIS INCLUDES LOSS ARISING FROM A FORGOTTEN PASSPHRASE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GRAVESWARE’S TOTAL LIABILITY UNDER THIS AGREEMENT SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE, OR TWENTY-FIVE UNITED STATES DOLLARS (US$25), WHICHEVER IS GREATER.

Some jurisdictions do not allow these limitations, so parts of this section may not apply to you.

8. Privacy

The Software collects nothing and transmits nothing. See the Privacy Statement accompanying the Software.

9. Term and termination

This agreement applies until terminated. It terminates automatically if you breach it. On termination you must stop using the Software and remove all copies. Sections 3, 5, 6, 7 and 11 survive termination.

10. Export and sanctions

The Software contains and performs cryptographic functions. Laws in some countries restrict the import, use, distribution or re-export of cryptographic software, and those restrictions apply to you regardless of anything in this agreement.

You may not use, export or re-export the Software in violation of any applicable export control, sanctions or trade law, including to any embargoed destination or any person or entity subject to applicable sanctions. You are responsible for determining what applies to you in your jurisdiction.

11. Governing law

This Agreement is governed by the laws of the Commonwealth of Virginia, United States, without regard to its conflict-of-laws rules. The exclusive venue for any dispute is the state courts located in Montgomery County, Virginia, or the federal courts serving that county, and you consent to their jurisdiction.

12. Entire agreement

This agreement is the entire agreement between you and GravesWare regarding the Software, and supersedes any prior understanding. If any provision is held unenforceable, the rest remains in effect.
